All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger.
We have already issued Fatwa 91249 clarifying that if the clothes become impure during the Tawaaf, it is an obligation to wash the impurity from the clothes before continuing the Tawaaf, because becoming free of any impurity is a condition for the validity of the Tawaaf according to the view of majority of the scholars but according to the Hanafi School of jurisprudence, it is only an obligation and not a condition. Nonetheless, according to most scholars of the Hanafi School of jurisprudence, becoming free of any impurity during the Tawaaf is a confirmed Sunnah.
Therefore, whoever performs Tawaaf while his body or clothes are stained by an impurity, then his Tawaaf is void according to the view of majority of the scholars and he is obliged to go back to perform the Tawaaf again if it is an obligatory Tawaaf and he is forbidden from having sexual intercourse with his wife if the Tawaaf is the Tawaaf of Ifaadhah, or Tawaaf for ‘Umrah until he performs it.
However, according to the Hanafi School of jurisprudence, this Tawaaf is valid but according to the opinion that it is an obligation to become free of impurities, it is an obligation to perform again the Tawaaaf as long as one is still in Makkah, otherwise he is obliged to offer a sacrifice.
Nonetheless, according to those who are of the view that it is desirable to become free of impurities, whoever performs Tawaaf while there is an impurity that is more than the size of a Dirham in his clothes, then it is disliked for him to perform Tawaaf but he is not required to do anything.
