Lied to his friend about a mobile phone he sold to him

Question:

ASSALAMOM ALAIKUM, my frnd zeeshan gave me a mobile to sell,he told me to give him Rs.1300 & whatever i get more than that is my profit as i deal with mobile phones. i sold it to my frnd prashant for Rs.1500 but i told him that i am nt earning on this mobile as he is also a close frnd of mine,also he is not aware that i buy and sell mobile phones. PLEASE let me know with reference to SAHIH HADEES whether the RS.200 i earned is halal or haram also let me know am i supposed to return him that RS.200.

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His Slave and Messenger.

 

If the owner of an item said to someone: “Sell this item for such and such a price and whatever you get more will be yours,” there is no harm in that and the owner gets the amount agreed upon after the item is sold. In Al-Musannaf, Ibn ‘Abbaas  may  Allaah  be  pleased  with  him was reported to have seen no impediment to man’s giving a garment to someone else and asking him to sell it at a specific price and what is beyond that price will be the latter’s. Az-Zuhri  may  Allaah  have  mercy  upon  him also said: "There is no harm when a person gives someone a commodity to sell and tells him that the extra amount is the latter's or is to be shared between them."

Therefore, the profit you earned with regards to the first owner of the mobile phone, is lawful. Yet, you made a mistake with regards to the new owner who bought the phone from you as you told him that you did not make any profit from the sale. It is obligatory on you to tell him the truth; if he accepted, you would own the RS 200; otherwise, you should return them to him.
