Assalamu Alaikum, I live in Canada, and some of my family lives in south Asia. For the Eid -Al Adha, I have been sending money back home to my brother to do Tadhya for me and my wife there. But I came across some Ahadith that Tadhya before the Eid prayer does not count. My brother does the Tadhya after he prays, but the Eid in there happens around 12 hours before it is in Canada due to time difference. I was practicing it in this way for two reasons: 1. There are poor people in my home country while in Canada I can't find someone in need to whom I can offer meat. 2. It is almost a pain to do Tadhya in here, in some cases you have to go to the slaughtering place early in the morning and miss the Eid prayer, which defeats the purpose. I have not searched if I can find a place where I won't miss the Eid prayer yet. Please advise me if my Tadhya back home as described above is correct. Jazakumullah Khaira
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger.
We have already issued Fatwa 89597 clarifying the ruling of appointing someone to slaughter on one's behalf.
As regards whether the appointer should slaughter the sacrifice after the 'Eed prayer in the country of the appointed person or in his own country (i.e. the country of the appointer), then the answer is that the sacrifice should be slaughtered after the 'Eed prayer in the country of the appointed person and not in the country of the appointer.
The Fiqh Encyclopaedia reads: “If the person who should slaughter the sacrifice resides in a country and he appoints another person who resides in another country to slaughter on his behalf, or that a person who is in another country appoints one to slaughter on his behalf in his own country, then what should be taken into account is the place where the sacrifice is slaughtered and not the place where the person who wants to slaughter is.”
