Inserting Finger in Vagina Does Not Make a Woman Lose Her Virginity

Question

Assalamualikum
I was involved in a haram relationship but Alhamdulillah I have quit the relationship now. But while I was in this relationship we got intimate and unfortunately he inserted his finger in my private part, we didn’t go beyond this, I just wanted to know if this counts as zina and if I can still be regarded as a virgin islamically, for I haven’t found peace since the incidence. I haven’t been myself since then, how do I repent from this ? Also I always feel scared that one day this person might expose me. Please provide me with some duas.
Jazakallah

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) is His slave and Messenger.

You did well by quitting this sinful relationship, but it is incumbent on you to complete your repentance and fulfill its conditions, which include, in addition to quitting the sin, regretting it and resolving not to commit it again in the future. We hope that what happened to you would be a lesson for you and others to beware of such illicit relationships and avoid the forbidden seclusion with the opposite sex and the like of acts leading to Fitnah (temptation).

The act you are asking about is not considered actual Zina that entails the application of the Hadd (prescribed corporal punishment), which is the penetration of the penis into the vagina, but it falls under the category of the means leading to Zina, and it is also a sin that necessitates repentance. However, you are not considered a non-virgin merely because of what happened, even if it resulted in the loss of virginity. Al-Mawsoo‘ah Al-Fiqhiyyah reads: “A woman who loses her virginity without sexual intercourse because of a violent jump, (insertion of) a finger (into the vagina), or heavy bleeding during menstruation and the like is considered a virgin in actuality and in terms of the Sharee‘ah ruling.” [End of quote]

If you are sincere in your repentance to Allah, The Exalted, then it is hoped that He will protect you, conceal your sin, and spare you any disgraceful exposure. He Says (what means): {And whoever fears Allah – He will make for him a way out.} [Quran 65:2] We advise you to frequently recite the supplications that include asking Allah for well-being. It was narrated on the authority of Abu Bakr As-Siddeeq may Allaah be pleased with him that the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) said: “Ask Allah for ‘Aafiyah (well-being). Verily, no one has been given anything better than ‘Aafiyah.” [Ahmad] It was also narrated that Ibn ‘Umar may Allaah be pleased with them said: “The Messenger of Allah sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) never abandoned these supplications, every morning and evening: ‘Allaahumma innee as’aluka al-‘Aafiyah fi ad-Dunya wal-Aakhirah. Allaahumma innee as’aluka al-‘Afwa wal-‘Aafiyah fi deeni wa dunyaaya wa ahli wa maali. Allaahumma ustur ‘Awraati, wa aamin Raw‘aati. Allaahumma ihfathnee min bayni yadayya, wa min khalfi, wa ‘an yameeni wa ‘an shimaali, wa min fawqi, wa a‘oothu bi-‘Athamatika an ughtaala min tahti (O Allah, I ask You for well-being in this worldly life and the Hereafter. O Allah, I ask You for pardon and well-being with regard to my religion, worldly affairs, family, and wealth. O Allah, conceal my faults, calm my fears, and protect me from before me and behind me, from my right and my left, and from above me, and I seek refuge with You from being taken unaware from beneath me.)’.” [Ahmad, Abu Daawood and Ibn Maajah]

We ask Allah, The Exalted, to bless you with well-being and concealment of sins.

Allah Knows best.
