Ruling on buying a vehicle from one's son that he acquired from a friend who cheated him in business

Question

Salman alikum brother, I want to purchase a vehicle to get some income out of it which will help to feed poor and to save. The vehicle which I want to purchase is from my son who took it away from his friend who cheated him in business. As per the information this vehicle was a share for both but the other partner sold some parts from it and took away the money. This vehicle was taken away by the municipality as it was lying outside for a very long time. Then my son who was cheated took it away from the municipality premises by paying fine and repaired it. As I know the story behind and I am getting it for cheap rate.. Is it haram or halal to buy this vehicle. My son is innocent and madloom.. He did not cheat him in any business dealing at all..he was very loyal towards his partner..My son wants to even give to me for free.. But I am thinking to pay him some amount to make it halal for me as a purchase of any other vehicle.. please advise.Jazak ALLAH KHAIR

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad, sallallaahu 'alayhi wa sallam, is His slave and Messenger.

You mentioned in your question that your son’s partner sold some parts of the car and left the rest neglected until it was confiscated. This implies that the partner left it out of his possession as he was in no need of it. If so, your son did nothing wrong by taking what was left from the authority that confiscated it. You may accept it from him for free, but if you wish to pay him for it, that is fine. However, if his partner did not leave it out of his possession and has a claim about the matter that differs from what was mentioned, it is necessary to hear his claim and consider his argument. Only Sharee’ah courts or the authorities competent in resolving disputes and litigation cases can decide on this.
