What is the legal ruling on converted Muslim women remaining married to non-believing husbands?
All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad is His slave and Messenger.
If a woman embraces Islam and her husband does not embrace it along with her, or shortly after her conversion, then their marriage must be invalidated because it is not acceptable or permissible for a Muslim woman to marry a non-Muslim man.
She is obliged not to allow him to enjoy her. If he embraces Islam, their marriage is still valid. However, if he does not embrace Islam during her waiting period, then they should be separated [once her waiting period expires].
Allah Knows best.
