what is the status of hiv carrier in islam?will it be considered as a normal patient or not?
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger.
The person who is affected with HIV virus is like any other patient in regard to the sanctity of his blood, money and honour, and his disease is not a reason for killing him unless he is an adulterer and the crime of adultery is proven against him with evidence or by him testifying to it, in which case he is killed as a Hadd (i.e. the corporal punishment determined by the Islamic Law) and not because of his disease. Rather, it will be due to him committing adultery and it is only the Muslim ruler who may inflict this punishment on him because it is only the Muslim ruler or his deputy who may apply the Hadd.
We have already issued Fataawa 85072 and 88742 about the religious view on AIDS, so please refer to them.
As regards your question whether or not his disease is considered as a normal disease, then there is no doubt that AIDS is a fatal and contagious disease with the Will of Allaah. It is not like other diseases, but a person who has this disease is permitted to seek treatment just like treating other diseases. This disease could be a punishment for the inflicted person or a means to wipe his sins (if he is a Muslim).
