Fatwa CenterShe terminated her 'Umrah when menses started during the Tawaaf
Question
There was a woman came for 'Umrah and during the Tawaaf she had the usual period. She immediately cut the Tawaaf and went back to Jeddah. What does she have to do and does she has to slaut blood?
Answer
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.
First of all, this woman should avoid the prohibitions which apply to a person in a state of Ihraam, as she is still considered as a Muhrim (a person in a state of Ihraam). When she becomes pure from menses, and has a bath, she has to go back to make the circumambulation around the Ka'bah and complete her 'Umrah (minor pilgrimage), and there is no harm on her in this case. However, if she committed one of the prohibitions of Ihraam out of forgetfulness, then we hope there is no harm on her, as Allaah says (interpretation of meaning): {"Our Lord, do not impose blame upon us if we have forgotten or erred."}[2:286]. Allaah further says (interpretation of meaning): {And there is no blame upon you for that in which you have erred but [only for] what your hearts intended. And Allah is Oft-Forgiving, Most Merciful.}[33:5]. In addition to this, the Prophet 
said: "Allaah is not going to hold accountable my nation about things they do by mistake, they forget, or on things that they are compelled to do." [Ibn Maajah and Ibn Hibbaan] However, if she has committed one of the prohibitions of Ihraam (other than sexual intercourse) while knowing the ruling, then it is an obligation on her to slaughter a sheep according to the prohibition committed. As regards sexual intercourse, it makes the 'Umrah void, in which case she has to complete this present 'Umrah and make it up again another time. Finally, we advise this woman to complete this 'Umrah as soon as possible after she finishes her menses and has a bath.
