Question
What is the ruling of the milk that the baby regurgitates during suckling? Is it considered impure (Najas)? Please reply in english as my computer is not Arabic enabled.
Answer
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.
The woman's milk is pure and so is her saliva. Therefore, if the baby regurgitates the milk from his mouth, if it remained as it is without any change, then it is pure like its original state. But if the baby swallowed it and then vomits it, and the milk has been changed from its original state, then it becomes impure according to the opinion of the majority of the scholars. Imaam An-Nawawi
stated in Al-Majmu' after mentioning the types of milks: 'The third type of milk is the milk of a human being; it is pure according to our school (meaning the Shaafi'ee school), this is the view point of Imaam Al-Shaafi'ee, and this is also the absolute decision of the Shaafi'ee scholars.'
